NOTICE OF IMPOSITION OF CONDITIONS AND RESTRICTIONS
ON JEAN-FRANÇOIS LIZOTTE’S LICENCE

NOTICE is hereby given that Jean-François Lizotte, residential real estate broker, licence number G7628, whose establishment is located in Outremont, has had conditions and restrictions imposed on his licence, following a decision by the Licence Issue and Maintenance Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ), pursuant to section 38 (2) of the Real Estate Brokerage Act.

On August 18, 2022, the Licence Issue and Maintenance Committee imposed the following conditions and restrictions on Mr. Lizotte:

That it is appropriate to maintain Mr. Lizotte’s licence and impose the following conditions and restrictions:

a) For a period of 24 months following notification of this decision, the licensee shall be prohibited from carrying on activities on his own account or from being designated as agency executive officer and/or from acting as one.

b) For a period of 24 months following notification of this decision, the licensee shall enter into and maintain a written agreement with the agency on behalf of which he carries on his professional activities, to the effect that the latter holds in trust the GST/QST payable to him, as real estate broker, until he is required to remit these taxes together with his return.

c) For a period of 24 months following the notification of this decision, the licensee shall enter into and maintain a written agreement with the agency within which he carries on his activities to the effect that the latter holds in trust a percentage of his remuneration to pay his taxes. The percentage shall be agreed upon between the licensee and his agency to pay his instalments.

d) A copy of the agreement mentioned in paragraphs b) and c) shall be sent to the OACIQ Registry Service within thirty (30) days of the notification of this decision.

e) In the event of any agency change during the period mentioned in paragraphs b) and c), the licensee must enter into an agreement under the same conditions with the new agency and send a copy thereof to the Organization’s Registry Service within 30 days following the agency change.

f) The period referred to in paragraphs a), b) and c) shall be suspended in the event the licensee suspends or revokes his real estate broker's licence.

g) The period referred to in paragraphs a), b) and c) shall end when the licensee accumulates 24 months as an active real estate broker’s licence holder as of the notification of this decision.

h) The licensee shall declare the bankruptcy of his business corporation and submit the necessary documents to the Organization's Certification Department within 30 days of notification of this decision.

i) The licensee shall send his certificate of discharge from bankruptcy to the OACIQ Registry Service within 30 days of his discharge.

j) Should the licensee not be discharged from his bankruptcy by August 6, 2023, his file will be resubmitted to the Committee.

k) Within six months following notification of this decision, he shall complete the training course entitled “The broker as a self-employed worker,” provided by the OACIQ Continuing Education Department or any other equivalent training accredited by the OACIQ.

l) Within 30 days of notification of this decision, send the OACIQ Registry Service proof of his registration for the training mentioned in paragraph k).

Should the licensee fail to comply with the above conditions and restrictions, his right to engage in real estate brokerage activities shall be suspended until he does so.

This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences.

The decision became enforceable on September 15, 2022.
