NOTICE OF REVOCATION OF
ENRICO BOILY’S LICENCE (D2224)

Be advised that on October 20, 2021, the Court of Quebec ordered that the real estate broker licence of Mr. Enrico Boily, whose establishment was located in Longueuil, be revoked, and prohibited him from applying for a licence with the OACIQ for committing the following offences: 

Count 1: On or around February 24, 2015, while performing a brokerage contract, completed the Declarations by the seller of the immovable form and signed in lieu of the sellers.

Count 2: Before or about March 16, 2015, prior to the signing of a promise to purchase by the prospective buyers, failing to ensure that they were informed of the Enviro-Option report dated July 29, 2011, revealing an abnormal fungal profile .    

Count 3: On or about April 7, 2015, while performing a brokerage contract, signed the promise to purchase in lieu of the sellers.

Count 4: As of or about April 7, 2015, allowed the transaction documents concerning an immovable located in Candiac to be signed by the parties while indicating a selling price that did not reflect reality.

Count 5: In Longueuil, failed to submit to the real estate agency for which he was acting, the following documents, namely: a) as of February 24, 2015, the Enviro-Option report dated July 29, 2011 and b) as of March 16, 2015, the promise to purchase.

Count 6: Prior to February 11, 2015, concerning an immovable located in Rivière-au-Tonnerre, failed to immediately send the buyer a written notice disclosing, among other things, his capacity as a real estate broker and the direct interest he had in the immovable.

Count 7: As of February 2015, concerning an immovable located in Rivière-au-Tonnerre, agreed with the prospective buyer that he would act as a nominee in the acquisition of said immovable, thus misleading third parties.             

Count 8: On or about February 23, 2015, concerning an immovable located in Rivière-au-Tonnerre, allowed a person other than the promisor-buyer to sign the promise to purchase.

Count 9: As of February 2015, concerning an immovable located in Rivière-au-Tonnerre, in support of the borrower’s financing application, allowed or tolerated false documents and/or inaccurate information to be sent to the National Bank of Canada.

Count 10: As of February 2015, allowed the transaction documents concerning an immovable located in Rivière-au-Tonnerre to be signed by the parties while indicating a selling price that did not reflect reality.

Count 11: In Longueuil, as of February 2015, failed to submit to the real estate agency for which he was acting, the promise to purchase and all related documents concerning an immovable located in Rivière-au-Tonnerre.

Count 12: Prior to August 9, 2015, concerning an immovable located in Saint-Amable, failed to immediately send the seller a written notice disclosing, among other things, his capacity as a real estate broker and the interest he proposed to acquire in said immovable.

Count 13: As of August 2015, concerning an immovable located in Saint-Amable, agreed with the prospective buyer that he would act as a nominee in the acquisition of said immovable, thus misleading third parties.

Count 14: Concerning an immovable located in Saint-Amable, allowed a person other than the promisor-buyer to sign the following documents: a) on or around August 9, 2015, the Declarations by the seller of the immovable form;  b) on or around August 31, 2015, the disclosure of remuneration agreement or remuneration sharing.

Count 15: As of August 2015, concerning an immovable located in Saint-Amable, in support of the borrower’s financing application, allowed or tolerated false documents and/or inaccurate information to be sent to the National Bank of Canada.

Count 16: As of August 2015, allowed the transaction documents concerning the immovable located in Saint-Amable to be signed by the parties while indicating a selling price that did not reflect reality.

Count 17: In Longueuil, as of August 2015, failed to submit to the real estate agency for which he was acting, the promise to purchase and all related documents concerning an immovable located in Saint-Amable.

Count 18: Concerning an immovable located in Saint-Amable, failed: a) at an unknown date occurring on or before September 9, 2015, to inform the nominee (the buyer) of the defects affecting the structure of the immovable; b) on or around September 9, 2015, to have work done on the structure of the immovable, even though he had received an amount for this purpose from the seller or his representative.
