LICENCE ISSUANCE - REAL ESTATE BROKER

You passed an OACIQ certification exam?
You have 12 months from the date your results were sent to you to apply for a real estate broker licence.

Are you a former OACIQ licence holder and your licence has been revoked for not paying the annual fees no later than April 30? You have 12 months following the revocation date to apply for a licence without having to complete a recognized basic training program and successfully taking an OACIQ certification examination.

You chose to stop carrying out brokerage activities for a while and maintained your acquired rights annually?
If your licence was revoked more than 12 months ago, you must complete a recognized basic training program and successfully take an OACIQ certification examination before you can apply for a licence.

Applicable fees
The total amount of applicable fees for the issuance of a real estate broker licence varies depending on the month in which you wish to start or resume your practice.

The InstanetFormsTM fees are detailed here and vary depending on the month in which you wish to start or resume your practice. Note that if you carry out residential real estate transactions, you must subscribe to InstanetFormsTM electronic forms to access current versions of brokerage forms.

The application examination fee and the criminal record check fee are not refundable. This is because upon receipt of a licence application by the Certification Department, several verifications are initiated by various departments of the Organization and by the company Mintz.

Therefore, in the event of a refusal to issue a licence or cancellation of the application, only the fees related to the right to practise, the contribution to the Indemnity Fund (FICI), the premium of the Professional Liability Insurance Fund (FARCIQ) and the subscription to the electronic forms will be refunded.

For example: if you want a licence to be issued to you to start your practice in September, you will pay $1,676.25 taxes included to which a fee of $53.66 taxes included has been added for subscription to InstanetFormsTM electronic forms. The grand total is $1,729.91 taxes included. Your licence will be valid from the date of issue until April 30. Like all licence holders, you will then have to renew your licence by April 30 every year. The amount payable at that time will cover an entire year.

LICENCE ISSUANCE - REAL ESTATE AGENCY

Is running your own real estate agency part of your career plan? Please read this article for more information. The amounts associated with the cost of an agency licence issuance can be found below.

Applicable fees
The total amount of applicable fees varies depending on the month in which you wish to start or resume your practice. An application examination fee is payable upon the submission of your application. This fee is not refundable and will be deducted from the total amount to be paid for the licence upon the issuance of your licence. Other administrative fees will also apply, depending on the situation.

**Note that these fees can be paid by you or your broker, as agreed.

For example:

You want an agency licence to be issued to you to start practising in September. You will be three licensees working for the agency–yourself as agency executive officer and two brokers. These two brokers will be allowed to operate within a business corporation.

Here is the calculation (all amounts below include taxes):

  • Make sure you send us your application within approximately 30 days prior to your start date along with the payment of the application examination fee of $645.01. 
     
  • The applicable fee you will pay upon acceptance of your application for an agency licence in September will be $865.68 ($1,510.69 minus the non-refundable application examination fee of $645.01 that was already paid when submitting the application).
  • An administrative fee of $289.74 ($96.58 x 3) will apply for processing the transfer of each broker’s file and your own file as agency executive officer.
     
  • An administrative fee of $193.16 ($96.58 x 2) will apply for the processing of the applications for authorization to practise within a business corporation for the two brokers.

Your agency licence will be valid from the date of issue until the following April 30. You will then have to renew your this licence by April 30 every year. The amount payable at that time will cover an entire year.

SPECIAL AUTHORIZATION

ACQUIRED RIGHTS

These rates apply to brokers whose licence is currently revoked and who wish to maintain their acquired rights. The total to be paid varies depending on the month in which the application is submitted.

LIFTING OF LICENCE SUSPENSION

Note: In accordance with the Regulation respecting broker’s and agency licences, your photo is valid for five years, since the last time you sent it to the Organization. Your photo change will not result in any fees if it is done within 12 months prior to the expiry of the 5-year period. Outside this period, especially if you change it too early, the above fees will apply.
