Be advised that on January 11, 2024, the OACIQ Discipline Committee ordered that the commercial and residential real estate broker licence of Mr. Daniel Fortin, whose establishment is located in Sainte-Thérèse, be suspended from February 16, 2024 to June 14, 2024, for committing the following offences:

Count 1: As of January 12, 2019, did not make sure to inform any potential buyer of ongoing disputes between a syndicate of co-owners and a real estate developer regarding unpaid maintenance costs and a notice of intent to change the use of two vacant lots adjacent to the immovable;

Count 2: As of May 8, 2019, did not disclose all the information in his possession to the buyers regarding:

b) proceedings brought by a syndicate of co-owners against a real estate developer for unpaid maintenance costs;

c) the extent of the water damage that occurred in a dwelling in 2017;

Count 3: On December 1, 2022, as part of an investigation conducted by the Syndic's Office, made false representations to the Assistant Syndic concerning ongoing disputes between a syndicate of co-owners and a real estate developer;

Count 4: On or around August 5, 2020, did not objectively inform the promisor-buyers of the results of the camera inspection of the drain regarding the potential presence of iron ochre;

Count 6: On November 16, 2022, as part of an investigation conducted by the Syndic's Office, made false representations to the Assistant Syndic about:

     a) the colour of water in a drain;

     b) the content of the video of a camera inspection of the drain on August 5, 2020;

     c) the reason why promisor-buyers withdrew their promise to purchase;

     d) the time when he became aware of the results of a drain water test.
