The form Exclusive brokerage contract – Purchase – Chiefly residential immovable containing less than 5 dwellings must be used by the broker to represent a natural person for the purchase of a residential immovable containing less than 5 dwellings.

Broker without a brokerage contract

A broker without a brokerage contract is considered as a “collaborating broker without a contract.” He works de facto for the seller. He cannot offer the buyer more than fair treatment. Only brokers who enter into a brokerage contract to purchase have the mission of protecting and promoting the interests of the buyer. The remuneration of the collaborating broker without a brokerage contract is based on the remuneration sharing arrangement provided for in the brokerage contract to sell (BCS).
